What Should I do If I think I have A Discrimination Claim?

Being discriminated in the workplace is not something anyone has to go through. Being discriminated against is not only overly frustrating, but it is also very discouraging for people who are looking to further their career. Luckily, there are many laws that protect employees from being discriminated against while they are in a workplace.

Firstly, we need to determine which types of discrimination claims you may have to file against a workplace. Gender, age, and workers compensation retaliation are some of the most common reasons for people filing claims against their employers. However, there are also circumstances like pregnancy, sexual harassment, and race discrimination that are covered under discrimination claims.

I believe I have a claim

If you think it is a possibility that you are going to need to file a discrimination claim against your employers there are a few steps that should be taken prior. We would suggest, if the situation allows, that you talk to your employer about your concerns. If you can sit down with your employer, you can gather a more clear idea as to whether or not they are discriminating against yourself or if it was a misunderstood situation.

We understand that not every situation allows for you to feel comfortable sitting down with your employer regarding your feelings. For example, if you have been sexually harassed by your employer you obviously do not want to sit and talk to them about it, and that is very understood. For situations like worker’s compensation it is sometimes best to visit with your boss first.

If you are unsure if your situation should lend to a conversation with your employer first, you can seek counsel from a discrimination claims attorney. An attorney will be able to quickly review your case and determine if it is going to make sense for you to visit with them about the situation or if you need to jump directly into legal action.

Hire A Great Attorney

If you have determined that you need to take legal action, you are going to want to hire an attorney who is very experienced in the type of case that you are going to be pursuing. Experience is going to be very beneficial for you, especially if you are looking at a difficult case that is going to cause a large ripple in your office.

You are also going to need to be sure that you provide as many details as possible to your attorney so they can present a solid case. They will be able to walk you through all of the different things that they may need from you to get started. Be trusting of them and give them as much information to work with as you can.

Being discriminated against in the workplace is something that no one wants to have to go through. No gain inside of a company is worth having to be harassed or discriminated against and it is important that you remember that. Do your best to decipher the best place to find help when you need it and don’t be afraid to share your thoughts and feelings.
